iTaukei Land Trust (Amendment) Act 2023 (Update)
Fiji’s Parliament enacted the iTaukei Land Trust (Amendment) Act 2023 (“Act”) on 6 April 2023 which came into force on 17 April 2023. The Act essentially reverses the iTaukei Land Trust (Amendment) Act 2021 which came into force on 1 August 2021. The Act amends section 12 of the main legislation – iTaukei Land Trust Act 1940, by deleting subsections (1A) and (3) and inserting section 12A.
Essentially, the amendment made to section 12 under the Act brings back the requirement for consent from iTaukei Lands Trust Board when dealing with iTaukei land. Any person intending to deal with iTaukei land must obtain the consent of iTaukei Lands Trust Board before doing so.
